Keith is partner in the law firm of Stikeman Elliott LLP and is located in its Calgary office. He is a member of the firm’s Energy – Oil & Gas and Energy – Power Groups, with more than 30 years of experience involving matters regulated by the Alberta Energy Regulator, the Alberta Utilities Commission, the National Energy Board, the British Columbia Utilities Commission and other regulatory authorities in Canada. Keith has represented clients in numerous utility rate, energy facility approval, environmental and resource development hearings and proceedings at both the provincial and federal levels.
He has appeared as counsel in many hearings regarding various Alberta facility applications, including gas processing plants, oil and gas wells, pipelines, oil sands projects, refineries and petrochemical developments, and respecting matters such as rateable take disputes, resource conservation schemes and gas over bitumen conflicts.
Keith has represented clients before the AUC regarding utility rates and terms and conditions of service. In recent years, he has appeared as counsel for the Alberta Electric System Operator in AUC hearings and is entirely familiar with all aspects of the current and proposed structure and operation of the Alberta electric market. Keith has acted as counsel for market participants in Market Surveillance Administrator investigation and enforcement proceedings and for parties involved in complex generator force majeure arbitrations.
He has extensive experience before the NEB regarding pipeline tolls and tariffs, cost of capital, pipeline construction applications, common carrier principles, capacity apportionment and open access pipeline issues.
Keith has also represented clients with respect to potential LNG developments, frontier and offshore oil and gas, northern pipelines and an electric power project in Tanzania.
He has appeared as counsel in regulatory-related matters before the Alberta Court of Queen‘s Bench, the Alberta Court of Appeal and the Federal Court of Canada. Keith was a member of the Board of Directors of a Canadian pipeline subsidiary of Koch Industries Inc., prior to its disposition.
